Privacy Policy
1. Overview
This Privacy Policy explains how MarketSpace USA ("MarketSpace," "we," "us," "our") collects, uses, shares, and protects information when you use our website and related services (the "Platform"). It applies to visitors, registered users, and MarketSpace Concierge customers.
2. Information We Collect
- Account Information: name, email, phone number, password, and preferences you provide when you register
- Vehicle Search & Browsing Activity: searches, saved vehicles, comparisons, and filters you use on the Platform
- Concierge & Transaction Information: your target vehicle, price preferences, and communications relayed between you and dealerships through the Concierge service
- Financing Referral Information: if you request financing, information you submit to be shared with a third-party lender or lending marketplace. MarketSpace does not collect or store your full Social Security number; that's collected directly by the lender if required
- Identity & Insurance Documents: if you choose to upload ID or proof-of-insurance to speed up your purchase, we store them securely and share them only as needed to complete your transaction
- Payment Information: payments made directly to MarketSpace (such as the Concierge fee) are processed by Stripe; we do not store your full card number
- Device & Usage Data: IP address, browser type, device identifiers, and usage data collected via cookies and similar technologies
- Communications: messages you send through chat, email, or phone, including records with our Concierge and support team
3. How We Use Information
We use the information we collect to operate and improve the Platform; create and manage your account; provide the Concierge negotiation service; connect you with dealerships, lenders, warranty providers, and delivery partners you choose to engage with; process payments; communicate with you about your account or transactions; detect and prevent fraud; and comply with legal obligations.
4. How We Share Information
We share information only as needed to provide the services you request:
- Dealerships — vehicle preferences, target price, and contact info, when you use MarketSpace Concierge or express interest in a listing
- Lending Partners (e.g., LendingTree, AutoFi) — information you submit if you request financing, so the lender can generate quotes or process an application
- Warranty Providers — information needed to generate a vehicle service contract quote, if requested
- Delivery/Logistics Providers — contact and delivery-address information needed to schedule transport
- Service Providers — vendors who help us run the Platform (e.g., Stripe for payments, hosting, analytics), under confidentiality obligations
- Legal & Safety — when required by law or to protect the rights, property, or safety of MarketSpace, our users, or the public
- Business Transfers — in connection with a merger, acquisition, or sale of assets, subject to standard confidentiality protections
We do not sell your personal information to data brokers for money. Sharing information with lending, warranty, or logistics partners at your request — for which MarketSpace may receive compensation — may be considered a "sale" or "share" under some states' broad statutory definitions; see Section 6 for your opt-out rights.
5. Cookies & Tracking Technologies
We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Platform is used. You can control cookies through your browser settings; disabling them may limit some features.
6. Your Privacy Rights
Depending on where you live, you may have rights under state privacy laws — including California's CCPA/CPRA and comparable laws now in effect in roughly twenty states — to know what personal information we've collected about you, request a copy or deletion of it, correct inaccuracies, and opt out of the "sale" or "sharing" of your information, including for targeted advertising. We will not discriminate against you for exercising these rights, and we may need to verify your identity before completing certain requests.
7. Data Security
We use administrative, technical, and physical safeguards designed to protect your information, including encryption in transit and access controls. No system is completely secure, and we cannot guarantee absolute security.
8. Data Retention
We retain personal information for as long as needed to provide the Platform, complete the transactions you've requested, and meet legal, accounting, or reporting obligations, after which it's deleted or anonymized.
9. Children's Privacy
The Platform is not directed to individuals under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we'll delete it.
10. Financial Information
When you choose to be referred to a lending or financing partner, information relevant to your request is shared with that partner so it can provide a quote or process an application; that partner's own privacy policy governs its handling of your information. MarketSpace does not use your financial referral information for unrelated marketing.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated by email or an in-app notice before they take effect.
